Terms of Service

Last updated: September 1, 2026

1. Scope

These Terms govern both the use of this website and any design services requested from Eric Nova Design — whether started through the "Start a Project" form, email, or Contra. These Terms apply to clients located in Italy. For clients located outside Italian territory, separately agreed terms apply on a case-by-case basis at the time of the project agreement.

2. Website Use

This site and its contents (design, code, copy, images) belong to Eric Nova Design unless otherwise noted. You're welcome to browse and share links to the site. Copying, scraping, or reusing the design or content for your own commercial purposes without permission isn't allowed. The site is provided "as is"; Eric Nova Design doesn't guarantee continuous availability or that it will be error-free.

3. Starting a Project

Every project starts with a written scope — sent by email or Contra and confirmed in writing by Eric Nova Design — describing deliverables, timeline, and price before any work begins. Verbal or chat discussions alone aren't binding.

4. Payment

Eric Nova Design works through two payment channels, each with its own terms.

Via Contra (default channel). The project follows Contra's own payment structure and protections (see Contra's Terms of Service at contra.com/policies/terms), including deposit handling and fund release. Preview files may be shared during the project; final source files are released according to Contra's own payment-release conditions.

Outside Contra, via PayPal (secondary channel). Payment in full is required before any project work begins. There's no partial deposit or balance due on delivery — work starts only once payment has been received into Eric Nova Design's account. This applies to every project started outside Contra, regardless of project size.

Preview or draft versions of deliverables may be shared before payment is complete; final source files are released only after payment in full, per the conditions of the channel used.

All fees and quoted prices are exempt from VAT and not subject to withholding tax, under Italy's regime forfettario (Art. 1, paragraphs 54–89, Law 190/2014 and subsequent amendments).

5. Revisions and Additional Requests

Projects include two rounds of revision as standard. Larger or more complex projects may include up to four, agreed in the written scope before work begins and confirmed by Eric Nova Design at kickoff.

Before the refinement phase, a project direction is presented along with the reasoning behind the choices made. At this stage only light adjustments — color, font, images — are allowed, and these don't count as a revision round. For images, you can point toward a general direction (e.g. "more X"); how that's interpreted is at the designer's discretion. Any other change, including rejecting the interpretation given, falls under the revision rounds already agreed.

Revisions beyond what's agreed, or requests for new features, pages, or work outside the original brief, are treated as a change order: quoted and agreed separately before starting, billed at $50/hour.

6. Right of Withdrawal (consumer clients only)

This clause applies only to consumers as defined under EU and Italian law (a natural person acting outside any trade, business, or professional activity). If you're a consumer client, you have the legal right to withdraw from this agreement within 14 days of booking. If you expressly request that work begin before that period ends, and acknowledge in writing that you'll lose that right once the service has been fully performed, the right of withdrawal ends once the deliverables are fully completed. If you withdraw before the service has been fully performed, Eric Nova Design may retain a payment proportional to the work already done, in line with applicable consumer law, rather than the full deposit automatically. This clause doesn't apply to business (B2B) clients.

7. Cancellation and Termination

Cancellation by the client (after the withdrawal period, or for business clients): the deposit or payment already received is retained to cover time already committed, and any milestone payment already made for completed work is non-refundable.

Late payment. If any amount owed to Eric Nova Design (including final balances, billing for extra agreed work as a change order, or amounts arising from unjustified payment disputes such as chargebacks) isn't paid within 7 days of the agreed date, a one-time 10% penalty is applied to the outstanding amount, regardless of the payment channel used. Source files remain withheld until the balance, including any penalty, is paid in full.

Termination by Eric Nova Design: if the client is unreachable for 5 days after a reasonable attempt at contact, Eric Nova Design may suspend or terminate the project, retaining all payments already received for completed work.

8. Ownership

Once a project is paid in full, the client receives an exclusive, worldwide license to use the final deliverables for the purpose agreed in the project scope. Eric Nova Design retains authorship of the work and the right to display it in its portfolio, in a case study, or in promotional material, unless the client requests otherwise in writing (e.g. for projects covered by an NDA).

9. Limitation of Liability

Eric Nova Design's liability for any claim relating to the Services is limited to the amount paid for that project, except in cases of gross negligence or willful misconduct, where such limitations don't apply under applicable law. Eric Nova Design isn't liable for indirect damages, such as lost business or revenue, arising from use of the deliverables.

For business (B2B) clients, this limitation of liability is a clause specifically approved by the client at the time the project scope is confirmed, under Articles 1341 and 1342 of the Italian Civil Code.

For consumer (B2C) clients, this limitation applies to the maximum extent permitted by applicable law, without prejudice to Article 33 of the Italian Consumer Code on unfair contract terms.

10. Governing Law

These Terms are governed by Italian law. Any disputes fall under Italian jurisdiction.
